1. Agreement
These Terms of Service ("Terms") are provided by Lumin Marketing Group ("Lumin," "we," "us," or "our"), Edmonton, Alberta, Canada. They describe supplemental conditions for Tally Pro - Tap Counter ("Tally Pro") and terms for using this website. Your App Store licence is governed by the Apple Standard EULA. These Terms do not replace that agreement.
By using this website, you agree to the provisions of these Terms that apply to website use. These Terms apply as additional app terms only when they are presented to you or validly incorporated into an offer in a manner permitted by applicable law. If they have not been, the Apple Standard EULA and applicable non-waivable law continue to govern your app licence. Please also read our Privacy Policy.
You must be legally able to enter an applicable agreement. If you use Tally Pro for an organization, you confirm that you have authority to act for it.
2. Licence and permitted use
Subject to these Terms and the Apple Standard EULA, Lumin grants you a limited, personal, revocable, non-exclusive, non-transferable licence to use Tally Pro on Apple-branded devices you own or control as permitted by the App Store usage rules.
You may use Tally Pro for lawful personal or internal business counting. You may not copy, resell, rent, distribute, reverse engineer, bypass technical safeguards, interfere with the app or advertising systems, use the app to violate another person's rights, or use Tally Pro in a way prohibited by law, except where a restriction is not permitted by applicable law.
3. Your content and local data
You retain responsibility for counter names, values, goals, history, and other content you create. This content is stored locally and may be shared with Tally Pro widgets or synchronized with a paired Apple Watch through Apple technologies. Lumin does not provide a cloud backup or account-recovery service for counter content.
You are responsible for maintaining device backups appropriate to your needs, protecting device access, and independently verifying any count where an error could cause harm or loss. Deleting Tally Pro, resetting data, losing a device, or a failed device backup may result in permanent data loss.
4. Free, Premium, and Remove Ads
The free experience may limit the number of counters and may display advertising. In the current release, the configured placement is a Google AdMob banner on the Focus screen. Premium is a monthly auto-renewable subscription that unlocks unlimited counters, extended Insights and full-history export, and removes ads. A verified legacy entitlement may provide the access shown in the app.
Remove Ads is a separate one-time purchase. It removes ads only and does not unlock Premium features. Features and limits presented on the App Store purchase sheet at the time of purchase form part of the applicable offer.
5. Purchases, renewal, and cancellation
Apple processes all payments through your Apple Account. Prices, taxes, billing periods, and any offer terms are shown before purchase and may vary by country or storefront. Lumin does not receive your payment-card details.
Premium automatically renews for another billing period unless you cancel through your Apple Account before renewal in accordance with the timing shown by Apple. Apple charges your Apple Account and manages cancellations, billing issues, and eligible refunds. You can view purchase options at More → Go Premium and find restore and subscription-management options at More → Settings.
Cancellation stops future renewal but normally does not provide a partial-period refund or end access before the paid period expires, except as required by law or Apple's policies. You can use Restore Purchases while signed in to the Apple Account associated with the transaction.
6. Advertising and third-party services
Free users may see advertising supplied by Google. Advertising, consent messaging, Apple StoreKit, widgets, and Watch synchronization rely on services or platform features controlled by Google or Apple. Their terms and privacy policies may apply. We are not responsible for third-party services beyond the extent required by applicable law.
7. Appropriate use and safety
Tally Pro is a general-purpose counting aid. It is not a medical device, emergency service, safety system, certified inventory system, or substitute for professional judgment, required records, alarms, or independent verification. Do not rely on it as the sole means of tracking medication, responding to an emergency, protecting health or safety, or meeting legal, financial, compliance, or custody obligations.

8. Ownership
Tally Pro, its software, design, branding, and related materials are owned by Lumin or its licensors and are protected by intellectual-property laws. These Terms do not transfer ownership to you. Feedback you voluntarily provide may be used to improve Tally Pro without obligation to you, but we will not claim ownership of your locally stored counter content.
9. Updates, availability, and changes
We may update, add, remove, or discontinue app features, access tiers, or compatibility to maintain, secure, improve, or adapt Tally Pro, subject to applicable law and commitments for paid access. Some updates may be required to continue using the app. We do not promise that every feature will always be available on every device or operating-system version.
10. Suspension and termination
Your licence ends if you materially breach these Terms or the Apple Standard EULA. Where reasonable, we will provide notice and an opportunity to correct a breach. Upon termination, you must stop using Tally Pro. Provisions that by their nature should survive, including ownership, disclaimers, liability limits, and dispute terms, will survive.
11. Warranties
To the maximum extent permitted by applicable law, Tally Pro is provided "as is" and "as available." We do not promise uninterrupted or error-free operation, perfect accuracy, preservation of local data, or suitability for a particular purpose. The Apple Standard EULA includes additional warranty provisions and responsibilities.
Nothing in these Terms excludes, restricts, or modifies a warranty, guarantee, condition, remedy, or other right that cannot lawfully be excluded, restricted, or modified.
12. Limitation of liability
To the maximum extent permitted by applicable law, Lumin will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost opportunities, lost data, business interruption, or losses caused by an inaccurate or missed count, device failure, synchronization delay, or reliance on Tally Pro for a safety-critical purpose.
Where liability cannot be excluded, it is limited only to the extent permitted by law. These limitations do not apply to liability that cannot lawfully be limited, including any rights or remedies available under applicable consumer-protection law. Nothing in these Terms waives your non-waivable statutory consumer rights.
13. Governing law
These Terms are governed by the laws of Alberta and the federal laws of Canada applicable there, without regard to conflict-of-law rules. Courts located in Alberta will have jurisdiction, unless the mandatory consumer law of your place of residence gives you the right to bring a claim elsewhere or requires another law to apply.
14. Apple
Lumin, not Apple, is responsible for Tally Pro, subject to the Apple Standard EULA. Apple has no obligation to provide maintenance or support beyond its legal obligations. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you as they relate to your licensed use of Tally Pro.
15. Changes to these Terms
We may update these Terms for legal, security, operational, or product reasons. We will post the revised Terms and update the effective date. If required by law, we will provide additional notice or request consent. Continued use after revised Terms take effect means you accept them to the extent permitted by law.
